Bright Mohammed, aged 36, made his first court appearance at the Iyaganku Magistrates' Court in Ibadan, Oyo State, on charges of failing to produce Ayotunde Fanimo. Fanimo, a defendant he had stood surety for, is accused of obtaining money by false pretence and stealing. Mohammed pleaded not guilty to the charge of perverting the course of justice.
The case was adjourned to October 29 for further hearing, with the prosecutor seeking a remand order. Magistrate Taiwo Adeoye ordered Mohammed to be remanded in Oyo State Custodial Centre pending the next adjourned date.
The court's decision to remand Mohammed exposes a gap in Nigeria's bail system. When a surety fails to produce a defendant, the legal system's response—detention—punishes the surety rather than addressing the root issue of absconding defendants. This case should push for stricter monitoring of sureties or alternative measures beyond detention.
