Nigeria's Judicial System: A Reflection of the Nation's Moral Decay
Imagine a society where the last hope of the common man is tainted by the very same corruption it seeks to eradicate. This is the grim reality of Nigeria's judicial system, where the rule of law is often sacrificed at the altar of personal gain. The recent keynote address by the President of the Nigerian Bar Association, Afam Osigwe (SAN), delivered at the 17th Ralph Opara Memorial Lecture in Enugu, shed light on this dark reality.
According to a 2024 report by the United Nations Office on Drugs and Crime (UNODC) and the National Bureau of Statistics (NBS), Nigerian public officials received a staggering N721 billion in cash bribes in 2023, with judges ranking among the top recipients. This disturbing trend has led to a crisis of confidence in the country's judicial system, where the powerful and corrupt have become the primary beneficiaries of justice.
The report also revealed that N9.4 billion was involved in bribes within the country's justice sector between 2018 and 2020, with lawyers and litigants identified as primary bribe-givers. This is a stark reminder that corruption is a two-way street, where both the "corrupters" and "corruptees" play a role in perpetuating the cycle of graft.
As Osigwe noted, when rulings are allegedly influenced by envelopes rather than evidence, the judiciary ceases to be the last hope of the common man and becomes the first refuge of the powerful and the corrupt. This is a damning indictment of a system that has lost its way and prioritizes personal gain over the pursuit of justice.
The NBA President's critique of the judicial system has sparked a heated debate within the legal community, with some members questioning the timing and tone of his remarks. However, his honesty about corruption within the Bar and Bench is commendable and thought-provoking. As he aptly put it, the NBA cannot claim to uphold the rule of law if it is afraid to speak the truth about its own internal rot.
